1. Acceptance of Terms

By accessing or using Nytivo ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Nytivo provides a software-as-a-service platform for EU AI Act compliance management. The Service helps organisations assess risk, document compliance, and manage their obligations under Regulation (EU) 2024/1689.

3. Not Legal Advice

Nytivo is a compliance management tool, not a law firm. Nothing in the Service constitutes legal advice. You are responsible for ensuring your compliance with applicable law. We strongly recommend consulting qualified legal counsel for your specific situation.

4. Subscription and Payment

The Service is offered on a subscription basis. Fees are charged in advance on a monthly or annual basis. All fees are exclusive of VAT, which will be added where applicable under EU law. Subscriptions renew automatically unless cancelled.

5. Data Processing

We process personal data as described in our Privacy Policy and Data Processing Agreement. By using the Service, you acknowledge and agree to our data processing activities.

6. Intellectual Property

Nytivo and its licensors own all intellectual property rights in the Service. You retain ownership of data you upload to the Service.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Nytivo shall not be liable for indirect, incidental, special, consequential or punitive damages. Our total liability shall not exceed the amounts paid by you in the 12 months preceding the claim.

8. Governing Law

These Terms are governed by the laws of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ireland.
